IFDA Legal Counsel Analyzes Feesers v. Michael Foods Ruling

At its most basic, it appears to determine that Feesers was in competition with Sodexo for the business of providing food products to institutional foodservice customers, and that Sodexo and Michael Foods had violated the price discrimination-related prohibitions of the Robinson-Patman Act.

The International Foodservice Distributors Association (IFDA) is following the case, now likely to be appealed, and offers a detailed update on the ruling and its implications to the industry. The update includes a copy of Judge Rambo’s opinion and a memorandum by IFDA’s legal counsel that spells out what happened in the case, the court’s reasoning behind its ruling, and what it could all mean for distributors going forward.
